Alcohol Policy
Sellers that wish list alcohol or wine on Bid and Win must have a current licence to sell these types of items. Contact your state Liquor Licencing for all details.
Sellers must place the licence number on the item listing.
Alcohol and Wine may only be traded domestically - within Australia.
All States have different laws and guidelines regarding the legality of trading Alcohol and Wine. Make sure you know your States laws and if (and where) you are allowed to post alcohol and wine. You research the liquor laws for all of Australia's States that may be involved in the transaction.
All Alcohol deliveries posted to a buyer must obtain the signature of a adult ( person over the age of 18 years of age )
Many States have specific laws based upon quantity and type of alcohol posted.
Sellers should have full descriptions of all signature and postage requirements for fulfilling the transaction when listing Alcohol items on Bid and Win.
Many States require that postage carriers have licences to transport alcohol.
Your Postage Carrier must be capable of obtaining the requisite signature. Australia Post is unable to solicit age verification upon delivery of an item.
Bid and Win is a Platform only...
Bid and Win only provides auction services for sellers to list items, or as appropriate solicit offers to buy and buyers to bid on items.
At no time does Bid and Win have control over items that are posted in the auction site, and cannot guarantee the authenticity and quality of said items. We are not responsible for the actions of sellers and buyers within the Bid and Win site. Any typographical errors, misprints, loss of merchandise/money, damage or failure of equipment are the sole responsibility of the item seller.
Use of this site is at your own risk - all content is presented "AS-IS". We cannot ensure that a buyer or seller will actually complete a transaction.
You as a seller or buyer will not hold Bid and Win responsible for other users actions or inactions, including things they post. You acknowledge that we are not a traditional auctioneer. Instead, the site is a venue only to allow anyone to offer, sell and buy just about anything, at any time, from anywhere, in a variety of pricing formats and venues, such as stores, fixed price formats and auction style formats. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
Authenticity Disclaimers ..
Sellers may not disclaim knowledge of, or responsibility for, the authenticity or legality of the items offered in their listings. Sellers should take steps to ensure their items are authentic before listing them on Bid and Win. If a seller cannot verify the authenticity of an item - the seller is to list this clearly in the auction page - if not they are not permitted to list it.
Cancellation of Listings ...
Bid and Win always reserves the right to cancel auctions / listings without notice or explanation.
There are many reasons why we may cancel or suspend a listing/s. The list below is just a few:

We may consider the auction to be of no commercial value.

The Sellers account has been suspended.

The Auction is in the wrong catagory.
-
The Auction title is not in keeping with the auction description.
-
The Auction description is not grossly inadequate or misleading.

Bid and Win is unable to contact the seller.
-
The sellers email address is invalid or not working.
-
The item is not considered to be genuine - eg. Pirated DVD
-
The Auction is for an illegal item.
-
The seller has posted an illegal link.
NOTE - If Bid and Win cancel a listing for any reason whatsoever, all bids are automatically removed by the system.
Contact Information ...
Your Contact Information on Bid and Win must be current - Bid and Win will suspend users due to:

Misrepresentation of identity (user) - representing yourself as another Bid and Win user or registering by using the identity of someone else.

False or missing contact information - falsifying or omitting your full name, address and/or telephone number (including the use of fax numbers or disconnected numbers)
-
Dead or invalid email addresses - this is determined when an email address bounces repeatedly (usually an error message that the email address or mail box is unknown or invalid)
NOTE - If you use incorrect, invalid or misleading or incomplete information in the registration process your account will not be activated.
If you later change your registration details to incorrect or invalid, misleading or incomplete information your account will be suspended.
Your contact information on Bid and Win must be updated whenever the need to do so arises eg. change of email address or telephone number.
Feedback Removal ..
Bid and Win, at its own discretion, may amend feedback left for another member in the following circumstances:

The feedback contains abuse, profanity, sexist or racial remarks, or refers to another site or member in an offensive manner.

The feedback was left by a non-paying bidder.

The feedback was left by a non-selling seller.
-
Reprisal negative feedback - eg. After the buyer pays for an item he discovers the item was not as described so he leaves negative feedback. The seller then leaves reprisal feedback. In this instance, the negative feedback for the buyer may be removed. Bid and win does not remove feedback because parties have mutually agreed to withdraw their feedback.
GST Policy ...
Due to government enacted legislation, from 1 July 2000 items bought and sold by Australians may be subject to a goods and services tax (GST)/
Bid and Win strongly recommend that all members contact the Australian Taxation Office (ATO) or their taxation advisor for information on the GST.

If the seller is charging EXTRA for GST he must clearly state so on his listing.
Links Policy ...
In general, Bid and Win allows the following, providing the intent of the link is not fee avoidance or the promotion of another online auction site:

One link to a page that further describes the item being sold in that listing.

One link to your email address that opens in an email client for potential buyers to ask questions about the item in that listing.

Links to photos of the item for sale.
-
Links to your Bid and Win store and or listings
-
Links to your About Me page.

One link to your listing terms and conditions - providing that this page does not contain any other links.

Linking to websites that offer to trade, sell or purchase goods and services, or including links for any purpose other than thise listed above are not allowed.
Prohibited links include, but are not limited to:

Links to webpages that offer to trade, sell or purchase goods or services outside of Bid and Win. This applies whether it is a static URL or an active link.

Links to websites or pages offering merchandise is not permitted on Bid and Win.

Links that encourage buyers to place their bids through a site other than Bid and Win.

Links to any Adults Only / Mature Audiences site.
NOTE - Bid and Win does not recommend Linking Email Addresses and Web Forms in Listings as it may lead to increased Spam to your account and attract potential spammers. We recommend buyers use the ASK A SELLER A QUESTION facility.
Mature Audiences ...
Under Australian Law it may be a criminal offence for you to buy or sell certain types of publications, films and computer games. The Classification (Publications, Films and Computer Games) Act 1995 sets out guidelines for the classification of these items. In general publications, films and computer games that are classified as RC (refused classification) or X are considered by the authorities as indecent. You may be committing an offence by buying or selling such items on Bid and Win.
It is illegal to have CHILD PORNOGRAPHY in your possession. Any such item listing that is brought to Bid and Win's attention will be ended immediately and the relevant information will be referred to the appropriate authorities, by law.
Misleading Titles...
Sellers are not permitted to create titles for their listings that do not accurately describe the item for sale.
Misuse of the ASK A SELLER A QUESTION facility ...
Bid and Win allows members to contact each other through the "Ask a seller a question" facility. The purpose of this facility is to provide an avenue of communication between Bid and Win users and prevent spam to your private email address.
"Ask seller a question" is not to be used as a spamming tool - eg. Come look at my auctions.
Non Paying Bidders ...
Bid and Win allow 3 chances for all buyers, after 3 non payment auctions, the buyers account will be suspended and the IP address will be banned.
Non Selling Sellers ....
Bid and Win allow 3 chances for all sellers, after 3 non sell items, the sellers account will be suspended and the IP address will be banned.
Offensive Content ...
Members may not publish content within a listing or forum that promotes or glorifies hatred, violence, racial or religious intolerance, or content that promotes existing organisations with such views.
Suspended User ...
When Bid and Win suspends a member for whatever reason, all listings, and/or bids by the member are automatically cancelled by the system.
Hazardous Materials....
Hazardous or dangerous goods are items that may pose a danger to health, safety or property while being transported. Many hazardous goods cannot be posted through the mail or commercial carriers at all. These items are not permitted on Bid and Win.
A few hazardous materials may lawfully be transported under certain conditions if they are properly packaged and labelled. Such items may be listed, provided that the listing contains clear notice of the hazardous nature of the material, and a description of the planned method of postage that complies with Australian Law. For details on particular hazardous substances and transportation requirements in Australia and internationally, refer to the information provided on the Australia Post website - www.austpost.com.au
Closing your Bid and Win account ..
Members may close their Bid and Win account at anytime subject to the following:

Any outstanding fees must be paid beforehand.

Advance notice of 48 hours is required.
-
Any Buy/Sell transactions you are involved in are fully finalised.
-
An account closure fee of $5.00 is charged if your account is in credit.
-
Any refund due is limited to $10.00 and is refunded on the last day of the month.
